Terms of Service

These terms are an agreement between you and Colorado Web Forge LLC, based in Lone Tree, Colorado ("Flomailr", "we", "us"), for your use of Flomailr: the website at flomailr.com, the app, the API and the hosted MCP connector. By creating an account or using Flomailr, you agree to these terms. If you use Flomailr for a business, you agree to them on that business's behalf.
Our Privacy Policy explains how we handle personal data.
Your account
You need an account to use Flomailr. Keep your password, API keys and connected apps secure, because you are responsible for what happens in your workspace, including actions taken with your API keys or by AI apps you connect. Tell us right away at hello@flomailr.com if you think your account has been misused. You must be at least 16 years old to use Flomailr.
Sending email responsibly
Flomailr is for email that people asked to receive. When you use it, you agree that:
- You only email people who gave you permission, and you can show how and when they did.
- You do not use purchased, rented, scraped or harvested lists.
- Every marketing email identifies you, includes a valid postal address, and lets people unsubscribe. Flomailr adds an unsubscribe link and your postal address to campaign emails automatically; do not remove or hide them.
- You honour unsubscribes. Flomailr keeps a suppression list of people who unsubscribed, bounced or complained, and will not send to them.
- You follow the laws that apply to your email, including CAN-SPAM in the United States, CASL in Canada and GDPR in the EU and UK.
You may not use Flomailr to send spam, phishing, malware, or content that is illegal, deceptive, harassing or that infringes someone else's rights, or to promote things that are illegal where they are sent.
Sending limits and suspension
To protect deliverability for everyone, Flomailr enforces limits on the server, including plan limits, daily caps, quiet hours and the suppression list. If a workspace's bounce or spam complaint rate gets too high, Flomailr automatically suspends its sending. We may also suspend or close a workspace that breaks these terms or puts other customers or our sending reputation at risk. Where we can, we will tell you why and give you a chance to fix the problem.
AI apps and automation
You can connect AI apps such as Claude or ChatGPT to Flomailr and let them design, edit and send email in your workspace. Flomailr provides safeguards for this: sends start as a dry run, a real send requires a separate confirmation, suppressed addresses are always skipped, and every action is recorded in your activity log. You remain responsible for what an AI app does with the access you give it, including any email it sends on your behalf, just as if you had done it yourself. Review drafts and dry runs before you approve a send. AI apps are provided by third parties under their own terms, and we are not responsible for how they behave.
Your content
You own the content you create or upload, including your designs, images and contacts. You give us permission to store, process and send that content only as needed to run Flomailr for you. You are responsible for having the rights to everything you upload, including images and the data of the people on your lists.
We own Flomailr itself: the software, the themes and templates, and the brand. You may use the themes and templates in email you send with Flomailr.
Plans and fees
Flomailr has a free plan and paid plans, as described on our pricing page. Paid plans are billed in advance as agreed when you upgrade, and fees are not refundable except where the law requires. We may change plans and prices, and we will give you at least 30 days' notice before a price change affects you.
The API and the MCP connector
You can use the Flomailr API and MCP connector to work with your own workspace. Do not use them to access other workspaces, overload the service, get around limits or safeguards, or resell access to Flomailr without our written agreement. We may change, limit or retire parts of the API and connector, and we will try to give notice of changes that break existing integrations.
Ending your account
You can stop using Flomailr at any time and ask us to close your account by emailing hello@flomailr.com. We may close accounts that break these terms or that have been inactive for a long time, with notice where we can. After an account closes, we delete its data as described in the Privacy Policy.
Disclaimers
We work hard to keep Flomailr running and your email delivered, but we provide it "as is" and "as available". We do not promise that it will be uninterrupted or error free, or that any particular email will reach the inbox, because delivery also depends on recipients' email providers. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about Flomailr is limited to the greater of the fees you paid us in the 12 months before the claim and 100 US dollars.
Indemnity
If someone brings a claim against us because of your content, your contacts, the email you send, or your breach of these terms or the law, you agree to cover our reasonable costs and losses from that claim.
Changes to these terms
We may update these terms. If a change is significant, we will tell account holders by email or in the app at least 30 days before it takes effect. If you keep using Flomailr after that, the new terms apply.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Colorado, and you and we agree to their jurisdiction.
